Terms & Conditions – Sabor del Sol

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  1. Sabor del Sol: the sole proprietorship operating under the name Sabor del Sol, established at Van der Ghiessenstraat 25, 1181 RS Amstelveen, the Netherlands, registered with the Chamber of Commerce under number 95548556, VAT number NL005160590B12.

  2. Customer: any natural person who enters into an agreement with Sabor del Sol via the webshop.

  3. Agreement: the purchase agreement concluded between Sabor del Sol and the Customer.

  4. Webshop: the website www.sabordelsol.nl

Article 2 – Applicability

  1. These Terms and Conditions apply to every offer, order, and agreement between Sabor del Sol and the Customer.

  2. Deviations from these Terms and Conditions are only valid if expressly agreed upon in writing.

  3. If one or more provisions of these Terms and Conditions are found to be invalid or unenforceable, the remaining provisions shall remain fully applicable.

Article 3 – Offer and Prices

Article 4 – Formation of the Agreement

  1. The Agreement is concluded at the moment the Customer places an order and Sabor del Sol confirms this order by email.

  2. After placing an order, the Customer will receive an order confirmation by email.

Article 5 – Payment

  1. Payment must be made using the payment methods offered in the webshop.

  2. Orders will only be dispatched after full payment has been received.

Article 6 – Delivery

  1. Sabor del Sol strives to dispatch orders as soon as possible.

  2. Delivery takes place at the address provided by the Customer.

  3. The risk of damage to or loss of products transfers to the Customer at the moment of actual receipt of the order.

  4. If delivery is delayed, the Customer will be informed accordingly.

Article 7 – Right of Withdrawal

  1. The Customer has the right to withdraw from the Agreement within 14 days after receipt, without stating reasons, unless an exception applies.

  2. The right of withdrawal does not apply to:
    sealed food products which, for reasons of hygiene or health protection, are not suitable for return and whose seal has been broken after delivery; perishable goods with a limited shelf life.
    If the right of withdrawal applies, the product must be returned unused and undamaged.

  3. The costs of return shipment are borne by the Customer.

  4. Refunds will be processed within 14 days after receipt of the returned products.

Article 8 – Product Information & Liability

  1. Sabor del Sol provides product information as accurately and completely as possible.

  2. The Customer is responsible for complying with storage and usage instructions.

  3. Sabor del Sol is not liable for damage resulting from incorrect use or storage of products.

  4. Allergen information is provided where applicable; the Customer remains responsible in case of allergies.

Article 9 – Complaints

  1. Complaints must be submitted within a reasonable period after discovery by email.

  2. Sabor del Sol will respond to complaints within 14 days.

  3. If a complaint cannot be resolved by mutual agreement, the Customer may make use of the EU Online Dispute Resolution (ODR) platform.

Article 10 – Force Majeure

  1. In the event of force majeure, Sabor del Sol is not obliged to fulfil its obligations.

  2. Force majeure refers to any circumstance beyond the control of Sabor del Sol.

Article 11 – Intellectual Property

  1. All texts, images, and content on the webshop are the property of Sabor del Sol, unless stated otherwise.

  2. Use of this content without prior written permission is not permitted.

Article 12 – Applicable Law & Jurisdiction

  1. All agreements are governed by Dutch law.

  2. Disputes shall be submitted to the competent court in the Netherlands.
